Terms of Service

1. Acceptance of Terms

By downloading, installing, and using the KoStKord Consumer App or KoStKord Business App (collectively, the "Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Apps.

2. User Accounts

2.1 Registration

You must be at least 18 years old to create an account. You agree to provide accurate, complete, and current information during registration.

2.2 Account Security

You are responsible for maintaining the confidentiality of your password and account information. You agree to notify us immediately of unauthorized access or use of your account.

2.3 Account Termination

You may delete your account at any time through Account Settings. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use License

We grant you a limited, non-exclusive, revocable license to use the Apps for your personal or business use, in accordance with these Terms. You may not:

• Reverse engineer, decompile, or disassemble the Apps
• Attempt to gain unauthorized access to systems or data
• Use the Apps for unlawful purposes or to facilitate illegal activity
• Interfere with or disrupt the Apps or servers
• Remove, alter, or obscure any proprietary notices
• Redistribute, resell, or license the Apps

4. User Content & Conduct

4.1 Acceptable Use

You agree not to submit content or conduct that is:

• Illegal, fraudulent, or deceptive
• Defamatory, harassing, or abusive
• Sexually explicit or obscene
• Infringing on intellectual property rights
• Harmful or violating others' privacy

4.2 User Content Ownership

You retain ownership of content you create. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use it to operate and improve the Apps.

5. Intellectual Property

The Apps, including all content, features, and functionality, are owned by KoStKord or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without permission.

6. Transactions & Payment

6.1 Product & Service Offerings

All product listings and prices are subject to change without notice. We reserve the right to refuse or cancel orders.

6.2 Payment Terms

You authorize us to charge your payment method for all transactions. Subscription fees renew automatically unless cancelled. Refund policies are governed by applicable app store policies (Google Play / Apple App Store).

6.3 Disputes

If you dispute a charge, contact support@kostkord.com within 30 days with evidence. We will investigate and respond promptly.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Indemnification

You agree to defend, indemnify, and hold harmless KoStKord from claims arising from your use of the Apps, violation of these Terms, or infringement of third-party rights.

10. Third-Party Services

The Apps may integrate with third-party services (payment processors, maps, analytics). We are not responsible for their practices, content, or policies. Use of such services is governed by their terms and privacy policies.

11. Termination

We may suspend or terminate your access to the Apps at any time, with or without notice, if you violate these Terms or for operational reasons. Upon termination, your rights cease, and we may delete your account and data.

12. Dispute Resolution

12.1 Informal Resolution

Before pursuing formal action, contact us at support@kostkord.com to attempt resolution.

12.2 Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

12.3 Arbitration

You and KoStKord agree to resolve disputes through binding arbitration rather than litigation, except for injunctive relief claims. Arbitration shall be conducted under the rules of the American Arbitration Association.

13. Modifications to Terms

We may update these Terms at any time. Continued use of the Apps after changes constitutes acceptance. We will notify you of material changes via the Apps or email.

14. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.
